Please read these terms carefully before downloading or using the Proof Camera application.
Welcome to Proof Camera (the "App"). These Terms of Use ("Terms") constitute a legally binding agreement between you ("User" or "you") and Proof Camera ("we", "us", or "our") concerning your access to and use of the App and its verification services.
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
1. Description of Service
The App is a mobile consumer utility designed to help users capture real-world media, verify its structural integrity against screen-captures (the "Analog Hole"), and generate cryptographically time-stamped, location-stamped PDF forensic reports ("Reports") to aid in documenting physical evidence.
2. User Accounts and Permitted Use
- Eligibility: You must be at least 13 years old to use this App.
- License: We grant you a revocable, non-exclusive, non-transferable, limited right to install and use the App on mobile devices owned or controlled by you strictly in accordance with these Terms.
- Prohibited Conduct: You agree not to attempt to reverse-engineer our backend verification server, bypass security protocols, flood our API with fraudulent data, or use the App to create intentionally misleading or malicious reports.
3. User Generated Content (UGC) Policy
In strict compliance with Google Play Developer Policies regarding User Generated Content:
- Ownership: You retain full ownership and intellectual property rights over any photos, videos, or data you capture through the App.
- Responsibility: You are solely responsible for the content you capture and share. You agree not to use the App to capture illegal, defamatory, invasive of privacy, or infringing media.
- No Public Hosting: Since this App operates as a private utility for evidence collection and does not feature public user-to-user social feeds, chat rooms, or public sharing boards, it does not host public UGC. However, any sharing of generated PDFs is the sole discretion and legal responsibility of the user.
4. Intellectual Property and Open Source Dependencies
- Our proprietary verification algorithms, server code, UI designs, trademarks, and logos are owned exclusively by us.
- The App utilizes certain open-source libraries (including components licensed under the Apache License 2.0). Open-source notices and license texts are accessible within the App's "Legal Notices" / "Open Source Licenses" menu and are complied with in full.
5. Disclaimer of Warranties (Critical for Legal Protection)
THE APP AND ITS SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESSED OR IMPLIED, THAT THE GENERATED REPORTS WILL BE AUTOMATICALLY ACCEPTED AS DE-FACTO EVIDENCE IN ANY SPECIFIC COURT OF LAW, INSURANCE CLAIM PROCEDURE, OR LEGAL DISPUTE.
WHILE OUR SYSTEM USES ADVANCED FORENSIC MATHEMATICS (FFT) AND SECURE TIMESTAMPING, WE DO NOT GUARANTEE 100% INFALLIBILITY AGAINST ALL EVOLVING METHODOLOGIES OF DIGITAL FALSIFICATION. THE FINAL DETERMINATION OF EVIDENCE ADMISSIBILITY RESTS SOLELY WITH THE RELEVANT LEGAL AUTHORITIES, JUDGES, OR THIRD-PARTY EVALUATORS.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, LOSS OF PROPERTY, LOSS OF LEGAL DISPUTES, OR DATA CORRUPTION) ARISING OUT OF YOUR USE OR INABILITY TO USE THE APP.
7. Termination
We reserve the right, without notice and at our sole discretion, to terminate your license to use the App or block your access to our server verification services if you violate these Terms.
8. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
